In recent years, most countries worldwide have adopted legislation and regulations that recognise the legality of a digital signature (standard electronic signatures) and deem it a binding signature. In addition to governments, many industries have established regulations i.e. the FDA 21 CFR Part 11 in the Life Sciences industry that define digital signatures as a replacement for handwritten signatures.

SignFlow is fully integrated with International Certificate Authority, GlobalSign with Adobe Acrobat® Certified Document Services.

SignFlow eSign Digital Transaction Management

Using PDF Signing to certify and add approval signatures to the document is the electronic equivalent of adding a notarized, wet ink signature. A certified document assures the recipient that the document is authentic, comes from a verified source, and has not been tampered with. Approval signatures expedite an organization's approval procedure by capturing the electronic approvals made by individuals or departments and embedding them within the actual PDF.

As a member of both Adobe’s Certified Document Services (CDS) and Approved Trust List (AATL), GlobalSign PDF Signing Certificates are compatible with Adobe Acrobat/Reader 8.0+

The Adobe CDS Signing Certificates that SignFlow offer are verified each time the PDF document is opened, which enables real-time verification. Signature validity is determined by checking the authenticity of the signature’s digital ID certificate using industry standard X.509 digital certificates chained to the Adobe Root Authority to allow automatic validation of authenticity of the author and integrity of the document.

SignFlow eSign Digital Transaction Management

A high level of independent identity authentication is provided through the collection of personal identity information, including fingerprints, and the verification of the information provided with the Department of Home Affairs. Advanced Electronic Signatures are strongly recommended for strong authentication, signing and encryption of electronic communications, transactions and processes which require by law this type of signature.

Section 13-2 of The Electronic Communications and Transactions Act (ECT Act) of 2002 confirms specifically that contracts cannot be denied legal enforceability merely because they are concluded electronically or through data messages. Law in South Africa makes provision that wet (ink written) signatures are not necessarily required to make agreements legally binding. Agreements in general are deemed binding once the parties reach agreement, whether electronically, verbally, or on paper. Just like in the physical world, it may from time to time be necessary to prove the validity of an agreement in court by presenting evidence.

SignFlow provides a digital audit trail (also called audit log) which is kept with the document in the SignFlow workspace. It is a chronological set of records that provide documentary evidence of the sequence of activities that have affected the document which are admissible in evidence under section 15 of the ECT Act of 2002 to support the existence, authenticity and valid acceptance of a contract.
